Which of the following most accurately describes the problem?

Keywords : Baines, Fleetwood

A MARRIED COUPLE must wait to see whether a bid for an 0-licence has succeeded because of concerns that they might be a front for their son's opera. tion, Baines Bros. whose licence for four vehicles and four trailers was revoked at the beginning of July. Robert Harold and Beryl Baines, trading as Baines Transport, of Fleetwood, had sought a new national licence for six vehicles and six trailers before the North Western Thffic Commissioner, Beverley Bell, at a Lancaster public inquiry on a site shared with their son's former business.

Robert Baines, known as Harry Baines, said that the firm dismantled boats and had facilities in New Holland, Fleetwood and Portsmouth. The vehicles were needed to transport the scrap and recyclable material. The Robert Harold Baines, who was a director of Baines Bros, was his son. That company had been engaged in breaking up fishing boats.

Harry Baines was aware of an incident when an offduty police officer heard a loud banging from one of Baines Bros' vehicles while it was on the road. When the company was contacted it had said that the vehicle was parked up awaiting repairs. Later the same day the vehicle was stopped at a check and found to have 10 loose wheelnuts, the loud noise being the wheel banging against the hub and wheel studs.

The driver was aware that the wheel was loose. He was of a religious nature and believed that if anything was wrong God would fix it for him.

In reply to the TC. Baines said that Baines Bros had gone into administration after problems with the Environment Agency over decommissioning Irish fishing boats. He had never worked for Baines Bros. He had bought that company's vehicles back from the official receiver. He admitted using a vehicle without a licence six weeks ago in an emergency as there was scrap to he moved.

The TC is to announce her decision in writing at a future date.
