Somerset tipper operator who was making his first appearance at a disciplinary inquiry in more than 20 years has been adjourned pending the production of additional financial information.

Moore's maintenance record, despite a warning letter about standards in 1996, gave rise to doubts whether he had the financial resources to maintain his vehicles properly, said the Commissioner.

and four delayed prohibitions had been imposed on Moore's vehicles, six of which were endorsed as showing a significant maintenance failure. Six of the prohibitions had been issued since April 1996. A number of the prohibitions had taken several attempts to clear and Moore's annual test record was poor. The majority of the defects listed related to tyres and brakes.

For Moore, David Cocks said he felt that prohibitions issued for a broken spring, an air leak and empty windscreen washers ought not to have been endorsed "S". Some £60,000 had been spent on vehi cle maintenance in the last financial year. Moore had changed his maintenance contractor after discovering he was submitting vehicles for test to find out what was wrong with them.

Moore said he had now introduced the maintenance system recommended by Cocks and his son had recently passed the CPC examination. He was willing to reduce the authorisation on the licence to two vehicles and two trailers and he undertook to have the vehicles roller-brake tested every three months.

The proceedings were adjourned after financial evidence was heard in private at Moore's request.
