the applicant may lose one or two vehicles, and I am quite prepared to grant an adjournment," said Mr. Else, the W...st Midland Licensing Authority, at Hanley. on Monday, during the examination of Mr. C. L. L. Corbishley, of Corbishley Bros., Bramshall, Uttoxeter, by his advocate, Mr. C. E. Herbert.
Brought before the LA under Section 178 of the Road Traffic Act 1960, Mr. Corbishley accepted the offer to enable more detailed evidence to be made available as to the kind of goods carried and journeys made with four vehicles on A licence.
Mr. Herbert admitted there appeared to have been a departure from normal user for three years, mainly in respect of cattle carrying, but claimed that any departure from normal user was because of ignorance rather than wilful neglect.
Mr. Else remarked it may have been ignorance before September 19, 1963, but at the hearing on that day he had warned Corbishleys about putting thztir house in order.
The LA warned Mr. Corbishley that a continuation to use any vehicles in breach of their normal user would aggravate any penalty to be inflicted. He also disclosed it had come to his knowledge that there were 70 breaches of the law relating to drivers' hours, which would inevitably lead to prosecution.
