Mr Billing said he had not perated any vehicles since his cence expired last August, as e had thought that would be legal.

Enforcement action against Or Billing had been taken by the Is.ouncil in 1974 yet his licence lad been renewed in 1975 with)ut any objection. For the Council, development control leader Keith Smith said the enforcement notice had only become effective in December 1975 following the determination of the appeal and that was after the last renewal application.

The council opposed the present application because access to Mr Billing's site was difficult and because the proposed use was prohibited under the coming legislation.

One vehicle and one trailer carrying Mr Billing's own produce would not contravene the enforcement notice.

Mr Hutchings said he understood the Council's fear that if a licence was granted a fullscale haulage depot might be developed on the site, but Mr Billing gave an assurance that he would not change the nature of his business.

A licence for two vehicles and two trailers was granted after Mr Smith said he was happy with that, but warned Mr Billing that his licence could be revoked if he violated his promise.
