Which of the following most accurately describes the problem?

• MAN's attempts to acquire 60% of the Spanish truck and bus builder Enasa have run in to problems. Its joint bid with Daimler-Benz has been given the thumbs down by the German Anti-Trust Authority. As Commercial Motor closed for press MAN was about to respond to the decision.

MAN says that if the AntiTrust Authority — which is like the British Monopolies and Mergers Commission — sticks to its decision: "It will not be in the strategic interest of MAN individually to acquire Enasa as a whole or parts of the company."

The Berlin-based authority is concerned that the joint bid — MAN would hold 60% of Enasa and Daimler-Benz 20% with the remainder held by the Spanish state-owned industrial holding company INI — could lead to both the German manufacturers holding an unfair trading advantage within the EC. MAN already holds a majority stake in Steyr.

The takeover bid has already gone before the EC Monopolies Commission in Brussels which also has to give its approval to the deal. At the launch of its new engine range last week, MAN insisted it was confident that the deal would eventually go through.

The UXT, seen for the first time at last year's Frankfurt show, has an unusual front-toback engine layout with a short propshaft driving the back axle via a flange gear at the front of the engine.
