Which of the following most accurately describes the problem?

QWe have adapted two of our fridge trailers by slinging the fridge unit under the trailer. This necessitated cutting away a portion of the sideguard.

One of the trailers was stopped (with tractor!) and the police told the driver that the trailer did not conform to Regulation 51 of the Construction and Use Regulations. We think he is wrong.

ANowhere in Regulation 51 does it mention how to deal with modifications such as you have made. "Ishe Regulations do state sideguards have to withstand a force of two kilonewtons without great distortion.

I think the relevance is whether the fridge motor constitutes part of the body — then paragraph (7)(b) of the Regulations applies which allows for such designs. I think the police would have a tough time proving the case.
