PALLET NETWORK Pall-Ex has been fined £100,000 for health and safety breaches after a driver was killed when a forklift truck fell on him.

Moray Inglis, 37, suffered fatal head injuries when his vehicle toppled over while he unloaded a trailer in January 2003. An ambulance was called but Inglis died at Pall-Ex's former hub in Gotham, Nottinghamshire. Nottingham Crown Court heard how Inglis was an experienced, qualified forklift truck driver, who had been working for the firm for around six months. Prior to the accident, Health & Safety inspectors had issued the company with an improvement notice after concerns were raised over vehicle speed and the unloading system at the site. Judge Dudley Bennet described it as "an accident waiting to happen", and said the company operated an unsafe system of work, which put pressure on drivers to work faster than it was safe to do so. The company admitted two breaches of health and safety regulations at an earlier hearing (CM 9 June).

Following the case, HSE inspector Frances Bailey said: "No fine will compensate for the tragic loss of a life, but the high penalty reflects the seriousness of the offence. Vehicles and pedestrians don't mix."

A company spokeswoman says: "A tragedy of this nature should not be an occasion for defensiveness on the part of a company and that is, indeed, not our approach. The death of Moray Inglis is something that will, forever, be a part of the history of this company, and it is our resolve that we will do everything in our power to ensure that workplace risk is maintained at the lowest possible level across all of our operations" oluistopher.tindall@rbi.co.uk
