AN ESSEX HAULIER. who worked without licence authority in an attempt to earn the money to applyfor an 0-licence, has lost his bid for his truck's return after it was impounded by VOSA.

South Eastern & MetropolitanTraffic Commissioner Christopher Heaps was told that when the loaded vehicle was stopped at the Thamesport Container Port on the isle of Grain the driver had told the traffic examiner than he was employed by Buckhurst Hill-based Michael Bull, trading as JM Haulage, and had been working on and off for eight months.

Seeking the return of the vehicle, Bull said he had decided to start his own venture and borrowed money from a family friend to buy a truck and finance the insurance, tax and its maintenance. He then applied for an 0-licence. However, it became clear that he could not obtain a licence unless he had .0,400 in the bank. He was in trapped by circumstance as he needed to start repaying the cost of the HGV. He decided to drive the lorry without an 0-licence to pay off the money owed and build up the funds required to obtain an 0-licence.

His only option was to reclaim the lorry so he could sell it to pay off his debts. He would then try to obtain the necessary funds and documentation before starting again. Ruling that there were no grounds for the return of the vehicle, the TC sai d that Bull had been aware that the vehicle was being used without licence authority.
