TRUCK DRIVERS in Scotland will be banned from smoking in their cabs under a new law passed by the Scottish Parliament last week.

The Smoking, Health and Social Care (Scotland) Bill will come into force on 26 March next year and aims to make all enclosed public places and workplaces smoke-free.

A spokeswoman for the Scottish Executive says: "Even though the driver may be the only person in the cab it is still a workplace and therefore falls under the remit of the legislation. Smoking in the cab will be illegal."

Chris Dubber, the United Road Transport Union's Scottish regional officer, says: "At one point a few years back the possibility of fleets having smoking and non-smoking cabs was looked at but this would he very difficult to organise. One of the questions now must be whether any in-cab ban is enforceable.

The Scottish parliament voted by 97 to 17 with one abstention in favour of the new law.
