THE appeal by D. W. Briggs (Plant Hire) Ltd against a decision by the North Western Traffic Area licensing Authority has been dismissed by the Transport Tribunal.

In a written decision the Tribunal agrees with the LA that the directors of the appellants — Mr D. W. Briggs, Mrs Briggs and Mrs Charles Briggs "were not good at managing cash flow problems".

All three had been directors of a number of companies between 1979 and 1983, all of which had been wound up, leaving debts in excess of £150,000.

The appellants claimed that it had been difficult to obtain money owed to them for work done. They agreed that they had no working capital.

The Tribunal report concludes with general guidance to LAs "we suggest it would be wise if all 'call up' letters conclude with the advice to the applicants to seek informed advice for example from a solicitor, before attending the public enquiry.
