Sutterby denied using a Volvo FL10 in a dangerous condition, in that the mono leaf spring on the first axle was broken, and when the permitted second axle and gross weights were exceeded.

PC Thompson said that when a Volvo artic driven by Sutterby was check-weighed at the Doxey dynamic axle weigher on the M6, the permitted gross weight was found to have been exceeded by 1,760kg, (10.3%), and the permitted second axle weight by 1,390kg, (13.2%).
