Sutterby denied using a Volvo FL10 in a dangerous condition, in that the mono leaf spring on the first axle was broken, and when the permitted second axle and gross weights were exceeded.
PC Thompson said that when a Volvo artic driven by Sutterby was check-weighed at the Doxey dynamic axle weigher on the M6, the permitted gross weight was found to have been exceeded by 1,760kg, (10.3%), and the permitted second axle weight by 1,390kg, (13.2%).
Questioned by Jonathan Lawton, PC Thompson said that he and a colleague weighed the vehicle. The signature on the certificate of weight was not his: he thought that it might be that of his colleague. Vehicle examiner Jeffrey Stubbs said that he had examined the Crane Fruehauf semi trailer and found that the two mono leaf springs on the first axle has slipped out of the balance beam.
