Which of the following most accurately describes the problem?

• A haulage driver, fined £35 for seven offences under the Transport Act, alleged at Leigh magistrates' court last week that he had been with a firm which made him work over the permitted hours.

Roy Warhurst, of Leigh, who was also ordered to pay £10 costs, was summoned for twice making false entries in his record book, failing to return the book at Leigh, and working more than 11 hours on four working days.

Mr J. S. Lawton, for the prosecution, said that Mr Warhurst was a fairly experienced driver and a silent check had been made on him by a traffic examiner in Scotland. He had recorded journeys from Bolton to Motherwell and then back to Bolton. In fact, both journeys had been done the same day but the records showed he had done them during two days.
