AN OPERATOR with no 0-licence and a reputation for non-attendance at inquiries failed to appear before the TransportTribunal when it was considering an appeal to return his impounded truck.

West Midland Deputy Tra tile Commissioner Fiona Harrington had denied return of the artic to Geoff Aston,trading as G<ransport Services, after it had been impounded in March 2(X)7 while carrying a load of hazardous chemicals for delivery toTDG Logistics 'Piledriver hadproduced a faxed copy of an 0-licence held by Geoffrey Whallet, trading as CiW Haulage; TDO Logistics had confirmed to Vosa that it was expecting a delivery from G<ransport Services.

But the trailer-hire company reported that the trailer was hired to R Gayden & Sons. Gayden confirmed it had been hiring trailers on to Aston.

The traffic examiner found that Aston had previously had vehicles impounded and had been called before the TC but had walked out of the public inquiry. Whallet's 0-licence was being used with intent to deceive without his knowledge or consent.

The DTC refused to return the vehicle when Aston failed to attend a public inquiry.

Aston appealed on the grounds that the vehicle had been sold to his transport manager,Tony Morris, and was still being paid for. He believed it was not his responsibility to check that Morris held an 0-licence.

When a request from Aston for an adjournment of the appeal hearing was refused, he requested that the appeal be heard in his absence.

Dismissing the appeal, the Tribunal said it did not believe his account of the circumstances surrounding the impounding.
