• A driver whose sacking led to a strike by drivers employed by Amalgamated Foods has lost his claim for unfair dismissal before a Birmingham Industrial Tribunal.

Jan Weclawek claimed that he had been victimised and unfairly treated in the way that he was dismissed, after the company had claimed that he had falsified worksheets. His union shop steward told the tribunal that the appropriate action would have been a fiveday suspension followed by a written warning.

The tribunal heard that bonuses paid to drivers were affected by the number of empty cages collected from customers. The company believed that Weclawek had intended to defraud them by rnisbooking the amount of cages on his worksheets by nearly 50%. They also took account of the complaint that he had been abusive to Amalgamated Foods' customers.

Weclawek admitted that his worksheets were incorrect, but said that he had insufficient time to fill them in properly. He denied that the overbooking was as great as claimed.

Rejecting his claim, the tribunal said they did not accept that he had been unfairly treated.
