Which of the following most accurately describes the problem?

15ft wide and so does not comply with the Construction and Use Regulations. For some time it has been used solely within one depot for hilag and moving heavy steelwork, but now it has become necessary to move it to another depot 15 miles away. Could it be used on public roads for this one journey and, if so, are there any special legal requirements?

A The movement on a road of such a vehicle would normally have to have regard also to the Motor Vehicles (Construction and Use) (Track Laying Vehicles) Regulations 1955 S1999. However, the Motor Vehicles (Authorisation of Special Types). General Order 1973, makes provision for the movement of engineering plant which, in one context, is defined as "a mobile crane which does not comply in all respects with the requirements of the Construction and Use Regulations or the Track Laying Regulations" (Regulation 19).

Regulation 21 lays down the conditions under which the mobile crane, as "engineering plant" can be used on roads. Subsection (b) requires that it shall be used only on a road for the purpose of proceeding from one place to another and not for lifting and transporting goods or burden when doing so. Subsection :d) prohibits the drawing of a trailer.

Subsection (g) lays down that the Dverall length of the vehicle shall not exceed 11 metres (36ft 1.068in); that it should have a braking system as aid down in Regulations 13 and 14 of he C & U Regulations; and that its ;teering, petrol tank and other design 'eatures will comply with legulations 16 to 24 inclusive of the & U Regulations where applicable; md that it also conforms to the -equirements of Regulations 51 and 53 to 69 inclusive of the C & U Regulations where these are applicable.

Regulations 71, 72 and 78 of the Track Laying Regulations must also be observed though these do not appear to apply in the case you quote.

Regulation 23(2) of the Special Order restricts the speed of pour vehicle to 12mph. Regulation 25 provides for the marking of projections of fixed appliances or apparatus. Regulation 26 stipulates that where the overall width of the vehicle exceeds 4.3 metres ( 14ft 1.296in) the approval of the Secretary of State as to time, date and route shall be obtained. Regulation 28 requires notice to highway and bridge authorities where the weights transmitted to the road surface by any of the tracks do not comply with what is laid down in the C & U or Track Laying Regulations.

The vehicle will, of course, have to be taxed and insured also to travel on the road.
