Which of the following most accurately describes the problem?

• The vehicle authorisation on the PSV Oper ator's Licence held by Ben Johnson & Son (Haulage), of Brandesburton, Driffield, has been cut from 10 to eight by North Eastern Traffic Commissioner Frederick Whalley. He has also cut the duration of the licence to expire in November 1990.

Evidence was given at a Leeds public inquiry that two vehicles had received immediate prohibitions at their annual tests. Vechicle examiner Sean Barlow said he had inspected three vehicles during an unannounced fleet inspection, imposing one immediate prohibition. He was told that the prohibited vehicle had been off the road for five months — but he had seen it in service only a matter of days before.

For the company, Robert Heslett said that despite instructions to the contrary, the vehicle had been used to replace a broken-down vehicle.

Managing director Benjamin Johnson had agreed that the vehicle seen by the vehicle examiner was taxed and had a current test certificate. Whalley said that in that case it should have been kept in a fit and serviceable condition.

Whalley warned that if the company did not respond to the clear warning it was being given, it was unlikely that its licence would be renewed.
