A Manchester company, whose managing director subjected a vehicle examiner to a tirade of abuse has to watt again to see what action, if any, will be taken against its licence.

Consideration of action to be taken against Archvickbased FDT Transport had previously been adjourned by the North Western Traffic Commissioner Beverley Bell while its maintenance records were investigated to see whether they were genuine (CM10-16 July). The company holds a licence for eight vehicles and eight trailers.

In the second stint of the hearing traffic examiner John Ci•eenhalgh said that on 8 July he had requested the production of tachograph records and details of all drivers employed. He received a faxed communication from the company's solicitors indicating that a large number of tachograph and maintenance records had been stolen from a van at the end of June. This had been reported to Greater Manchester Police. Greenhaigh added that no drivers' details had been produced.

For the company, Charles Stansfield said that MO Robert Thomas accepted that technically speaking he was in breach of the requirement to produce tachograph charts for the day on which the theft was discovered.

Traffic examiner Christopher Howarth said that he had visited the company's maintenance contractor and was told that the vehicles were usually inspected over the weekend and picked up on a Monday. The IC commented that it appeared that the maintenance records were authentic.

Thomas said that his practice was to take the current week's charts from the drivers on a Friday to check them and work out their wages before handing them back to the driver on the Monday. The tachograph charts and maintenance records had been in a holdall in the van and it was stolen along with his toolbox when the van was parked outside the company's premises. He had taken them home with him over the weekend to collate them following the last hearing.
