The former MD of a Loughborough haulier who was banned from ho ding a licence following the discovery of "disgraceful illegal activities" at the firm has now had the decision reversed.
Alan Sherwood, former managing director at Loughborough-based F Sherwood & Sons, was disqualified from holding an Operator's Licence in any traffic area in 1998 by Eastern Traffic Commissioner Geoffrey Simms.
Simms revoked the company's licence for 55 vehicles and 75 trailers because of unlicensed subcontracting and an unauthorised operating centre. The TC also disqualified the company for two years and retired director John Cartlidge for 12 months.
In disqualifying Alan Sherwood, the TC said that as managing director he had to take the ultimate responsibility for the firm's conduct. The disgraceful illegal activities had taken place over a considerable period of time and might well have continued had the VI not discovered them.
As the weeks and months passed the illegalities continued, yet they should certainly have been terminated when they became obvious to the directors. What had occurred struck at the very integrity of the 0-licensing system. That decision was subsequently upheld by the Transport Tribunal, on appeal, and Sherwood's disqualification took effect at midnight on 18 Apri11999.
Simms recently received a request from Sherwood seeking a review of his indefinite ban. He has decided to remove the order with effect from September.
