Which of the following most accurately describes the problem?

licence application are posted at the same time so that the clerk to the Licensing Authority concerned receives his within the specified 14 days but the applicant does not receive his copy until after the 14th day, would the applicant have grounds for having the objection dismissed?

A Whilst it would be solely within the

jurisdiction of the Licensing Authority to give a ruling on this matter we would point out that the Road Traffic Act states that objections must reach the Licensing Authority not later than 14 days after notice of the application has appeared in the "Applications and Decisions". It also states that a copy of such objections must be sent by the objector to the applicant at the same time. It would appear therefore that if the notice of objection was sent at the same time this would meet the requirement of the Act whether or not the applicant received his copy within the 14 days required by the Licensing Authority.
