Which of the following most accurately describes the problem?

• The Operator's Licence of Gerald Smith's firm JED Scaffolding, of Caerwent, has been partially suspended until his vehicles are certified as roadworthy.

Smith, who appeared at disciplinary proceedings before South Wales Traffic Commissioner John Mervyn Pugh, was seeking renewal for three vehicles and two trailers. Mervyn Pugh initially proposed to suspend the whole fleet, but after Smith had said that would put him out of business he was allowed to continue operating one vehicle which he assured the Commissioner had passed its annual test in August.

Mervyn Pugh said that this was the second time that Smith had appeared at a public enquiry because of unsatisfactory maintenance.

The renewal application would be considered as soon as all of Smith's vehicles, including the one he was still allowed to operate, had passed their moT tests.
