• A case mvolving driver's hours and tachograph offences alleged to have been committed by Doncaster hauliers Emm's Sons, and one of the company's drivers, has been adjourned by Kirkby Magistrates after the court clerk decided there was insufficient time to deal with it, because of its "considerable complexities".
The company denied four offences of using a vehicle when the driver had failed to take sufficient daily rest; three offences of using a vehicle when the driver had had a daily driving period in excess of 10
hours; one offence of using a vehicle when the driver had driven for 41/2 hours without taking a 45-minute break; two offences of using a vehicle and failing to ensure that the tachograph had been used correctly; and one offence of using a vehicle when the tachograph seals had not been intact. The driver concerned, Shaun Hornsby, also denied all the above charges.
Defending, Stephen Kirkbright indicated that one of the issues would be whether the charges against the company were technically defective.
