BECAUSE of extenuating circumstances Mr. L. Hall, the West Midland Deputy Licensing Authority, dealt with a complete change of normal user by Mr. E. I. T. Worton, West Bromwich, by caution instead of suspension, at Birmingham, last week.

Mr. N. Carless, for Worton, who was stiAing renewal of his one-vehicle A licence, said he had been in serious illhealth and undergone 27 operations in the past two years. As a result, his son. Mr. E. Worton, had managed the business since 1957. At the last renewal in 1955, the normal user was mainly meat and meat products, but after derationing of meat in 1954, there was a gradual decline of his traffic.

There had been a complete change and they now asked for "iron, steel, brass, foods and building materials, London, the South East, Liverpool, Manchester, Newcastle upon Tyne and South Wales." These events occurred before the Hesketh and Knight appeals, and it was not realized that a new licence should have been applied for until now.

Mr. Worton, in evidence, said his main traffic was now construction steel, tubular farm gates and wheelbarrows. Other items mentioned were only a small proportion of the total.

After hearing two supporting witnesses, Mr. Hall said it was obvious that when the main traffic dried up the applicant thought he was entitled to seek work elsewhere without notification. The breach of normal user would be dealt with by a severe warning and a grant would be made, if there were no objections after republication in the terms of the stated main traffic,
