MUIR., Metropolitan IVILicensing Authority, said he was prepared to take a lenient line when considering the case of Mr. William Hogger, St. Katharine's Way, London, EA, at a public inquiry on Tuesday. The haulier, whose vehicles were under contract to fruit and vegetable merchants at Spitalfieids Market had twice been convicted, in 1957 and 1958, for using them outside the terms of the contracts.

For Mr. Flogger, Mr. E. H. B. Palmer said that his client had been in ill-health since 1953 and had spent long periods in hospital. He had been convicted for permitting one of his vehicles to be improperly used when under contract to W. and .H. Bailey, produce merchants, and had dismissed the driver concerned. He himself was unfit to drive and his finances were in a poor state.

At present he had one vehicle on contract work for Baileys and two for Marshall and Partners, Ltd., Spitalfields. He employed two of his sons as drivers and was confident that neither they nor his third driver would involve him in further breaches.

Mr. Muir observed that Mr. Palmer had told him nothing of an earlier conviction at Stratford in 1957.

The Licensing Authority said he took note of Mr. Hogger's ill-health during the period under investigation. Nevertheless, the haulier appeared to take insufficient account of his contracts. On this occasion he had decided to take no further -action.
