Which of the following most accurately describes the problem?

APPEALS lodged by Birmingham and Midland Motor Omnibus Co., Ltd., North Western Road Car Co., Ltd., Majestic Express Motors, Ltd.. and East Kent Road Car Co., Ltd., against the grant by the West Midland Licensing Authority of a licence for a new Dudley-Margate express service to Don Everall, Ltd., have been dismissed with costs. The appeals were heard by Mr. W. Tudor Davies, at Birmingham.

As reported in The Commercial Motor on January 16, B.M.M.O. claimed to have operated the route without competition since 1929. Since the war, the concern submitted, three other operators had been granted licences.

The respondents argued that the appellants held no monopoly rights to the route. There was no reason why passengers wishing to travel to Margate from the Birmingham area should have to travel to Birmingham first, as was nccesary with the B.M.M.O. service.
