Ltd., High Street, Burtonon-Trent, for a-rule nisi to the West Midland Traffic Commissioners was granted by Justices Talbot, Macna.ghten and du Parcq, in a King's 'Bench Divisional Court, on Monday. The rule called on the Commissioners to show cause why they should not hear and determine according to law an application by the coath company to back licences for an express service from Church Gresley to Blackpool.
The Road Traffic Act, 1930, said counsel, stipulated that the Commissioners should hear in public applications for backings, and the submission was that, in the present case, the Cornmi§sioners had not properly heard the application.
It seemed that objection had been taken to a renewal of the backing, because of an allegation that the cotnpany had broken a condition of its licence. The East Midland Commissinners had decided to await the decision of the West Midland Commissioners. The company's case was that the latter Commissioners had refused the application without hearing evi." dente or explanations by the company, and had acted in a peremptory way contrary to law.
