• The Scottish lawyer who is single-handedly campaigning to stop agricultural hauliers carrying out general haulage with rebated red diesel in their tractors, has fired off a warning letter to the Scottish Parliament.

The lawyer says he is not satisfied with the answer he received from Chancellor Gordon Brown in March. Brown insisted that higher fines for the misuse of red diesel would be an adequate deterrent

In a letter to the petition section at the Scottish Parliament the lawyer says: "The missing link here is that in Scotland only two diesel testing units exist and the staffing at Customs 86 Excise units has not been increased."

Continuing increases in fuel duty, coupled with the apparent misuse of rebated fuel, are creating a situation in which "well regulated and fuel duty paying hauliers just cannot compete," he adds, concluding that if nothing is done the number of small operators will continue to decline.
