• Springvale Removals has been ordered b a Birmingham i dustrial tribunal to repay £78 it deducted fron the wages of a driver to pay for damage to his vehicle.
Driver David Cocker had claimed that the deduction m. illegal under the 1986 Wages Act. The tribunal heard that Cocker had been taken on fol four-week probation. Though he had asked for a written copy of his contract of emplo: ment, he was not given one and said that he was never asked to sign any document.
Cocker began work on 13 March, and within 10 days hc was involved in four incidents resulting in damage to the tui of ,M00. On 24 March, Cock( was dismissed with .278 deducted from his wages.
In its decision, the tribunal said that employers should IR make any deduction unless r€ quired to do so by law, undei the contract of employment, with the written agreement c the employee.
