Which of the following most accurately describes the problem?

A FLEET owner who made false statements in

his application for a B licence is to have the licence suspended for three months, said the Metropolitan LA, Mr. D. I. R. Muir, in a reserved decision this week.

Mr. Muir held an inquiry on December 29 to enable the Kent Salvage Co. Ltd. to give reasons why the licence should not be revoked because of false statements made by Mr, Caleb Augustus Roe, majority shareholder and director, of Maidstone Road, Headcorn, Kent.

In his decision Mr. Muir said it was not in dispute that false statements were made. Mr. Roe's explanation was that he was flustered and nervous at the time. He said that he had not been a director of C. A. Roe Ltd. and that he had changed over to a new fleet on the formation of Kent Salvage. Neither statement was true.

"I am anxious to be fair to Mr. Roe. He is clearly not a very intelligent man and I can well believe that his directorship of C. A. Roe Ltd. was nominal and that he was completely dominated by his father," said the LA.

At the same time it would be wrong to permit hauliers who attended public inquiries to imagine that false statements could be made with impunity.

"I shall suspend this licence for three months from January 15. There will be a further opportunity to review the conduct of the new company when the licence expires in October," added Mr. Muir.
