nAMAGES of £268 17s. and costs were

awarcled at Sheffield, last week, to Shirkers of Sheffield, Ltd., vehicle dealers, against Eric Nortcliffe, haulier, Attercliffe, Sheffield, for loss of profit through breach of contract.

Shukers said ap agreement had been made whereby Mr. Nortcliffe would buy a new oilengined lorry valued at over £2,000. He broke the agreement by cancelling the order after signing a hirepurchase form. The damages claimed were the amount of profit that Shukers would have made if the deal had gone through.

In evidence, Mr. Nortcliffe said he signed the form when final details of " extras" had not been settled. Afterwards. the company telephoned him to say that the price would be about £400 more than the sum originally mentioned. This was too much, so he decided not to go through with the purchase.

The parties had done business together in. the past without complaint against each other, so neither could be termed "fly by nights."
