• A licence application by a Southampton haulier refused because of his bankruptcy has been referred back to the South Eastern LA by the Transport Tribunal to give the operator an opportunity of proving the bankruptcy order has been discharged.

Thomas Colclough trading as Tommy International Transport had applied for an international licence for one vehicle and one trailer in possession with three vehicles and one trailer to be acquired.

Producing a photostat copy of his discharge, Colclough said the urgency of getting a licence was that he had to apply for international journey permits for next year by December 15 otherwise he would have to continue using a foreign-based vehicle registered in Luxembourg.

Referring the case back to the LA, Tribunal President Judge Inskip, said there was nothing wrong with the LA's decision. It was the only decision the LA could have come to as at the time Colclough was an undischarged bankrupt.
