Which of the following most accurately describes the problem?

• An estimator for a removal company had given an estimate for a household removal from Hertford to Torquay but while the company's vehicle was being loaded at Hertford a small van arrived with some rolls of cloth and the removal men were asked to take these as part of the household removal. This they did but the vehicle was later stopped and found to be overloaded.

The Western deputy LA. Mr A. Caffin. was told this when the company, C. J. Dimond and Sons Ltd, was called before him under Section 69. Mr I. H. Baker, managing director of the company, said that notices had now been placed in the driving cabs of all vehicles warning drivers of overloading. The deputy LA accepted that the company recognized the seriousness of the offence and he decided to take no action.
