QUnder current EC drivers' hours for coaches, is daily rest measured in the 24 hours preceeding the end of the working day, or in the 24-hour period commencing at the time the driver starts work at the begining of the day?
From the reading I have done I believe that it is measured in the 24 hours preceeding the end of the working day. So whenever a driver is working under EC law he must be able to count back 24 hours and say that he has taken daily rest within this period.
However, what happens if at the end of the day the driver reverts to domestic hours law? Does he still have to be able to count back 24 hours from the time he was driving under domestic law and be able to say that he has had a daily rest period in the previous 24 hours?
If daily rest is measured in the 24-hour period from the time the driver commences work at the start of the day, would this rest still have to be taken in that period, if at the end of the day, he reverts to domestic duties or driving (ie out of scope)?
AJ, Tenby A In the EC Regulations, the /24-hour day starts as soon as you commence work which has been preceeded by a daily rest period.
The wording on many summonses is: "You did fail to take sufficient daily rest in the preceeding 24 hours." Each 24hour period is strictly separate. You are correct when you say a driver must count back because, even if he reverts to domestic driving in that period, his rest period is governed by EC Regulations.
