Which of the following most accurately describes the problem?

• Two drivers from Manchesterbased R C Cole who failed to take sufficient weekly rest cost the company and themselves £1,000 after they were convicted in their absence by the city's magistrates.

Drivers David Saxon and David McLean, both of Manchester, were accused of three offences of taking insufficient weekly rest, and the company was accused of permitting the offences. At a previous hearing Saxon and the company had indicated that they were pleading not guilty. However, they failed to appear for trial and the magistrates agreed to hear the case in their absence.

Traffic examiner Terence Brown said an examination of the company's tachograph records revealed that Saxon had driven for as many as 10 consecutive daily driving periods without taking a weekly rest period, and McLean for as many as 18.

The magistrates fined each driver 290 with £60 costs. The company was fined 2600 with 2200 costs.
