AT Birkenhead Police Court, on Monday, the police withdrew a summons against J. J. Martindale, of Hornby Street, Liverpool, for failing to maintain in good order the brakes of a steam lorry.
Applying to withdraw the summons, Chief Inspector Walter Jones said that the steamer and trailer in question weighed 18 tons. Mr. J. P. Wilson, the defendant's solicitor, had pointed
ut that there was no provision in the lotor Vehicles (Construction and Use) egulations, 1933, which applied to he vehicle in question. It was regis

ered in 1926 and the regulations aplied to vehicles registered during the ear 1928 and later. .
. The Chief Constable had communited with the Ministry of Transport, 'hich had admitted the defect in the gulations. The Minister enclosed
with his letter the draft of new regulations, in which provision was made for vehicles registered before 1928 to have efficient brakes.
When the summons was issued, continued the Chief Inspector, the police did not know the date of registration of the vehicle. Apparently, heavy vehicles registered before 1928 need not have brakes at all. This was an incredible and chaotic state of affairs.
