Which of the following most accurately describes the problem?

recovery vehicle? Although we have been issued with trade plates, being haulage contractors with our own maintenance section, we do not own a recovery vehicle in the true sense of the word—what we utilize is an articulated tractive unit which is not in service on our general operations.

A The definition of "recovery vehicle" is found in the second schedule to the Finance Act 1969, Section 2. It reads: -Recovery vehicle means a vehicle on which there is mounted apparatus designed for wholly or partly raising or for drawing a disabled vehicle, and which is not designed primarily for the conveyance of goods other than a disabled vehicle wholly raised by that apparatus, and which carries no other load other than articles required for the operation of, in connection with, that apparatus or otherwise for dealing with disabled vehicles."

It would seem that the articulated tractive unit, which you have been using as a breakdown wagon does not fall within the above definition and if it is used as a "recovery vehicle" on trade plates an offence is committed.

You could either equip a vehicle as a recovery vehicle to come within the above definition and use it with the trade plates, or license the vehicle you intend using for this purpose in the ordinary way.
