Which of the following most accurately describes the problem?

DESPITE the Transport Minister's inspector recommen-ding that an appeal by G. Liversedge, trading as Morris Green Coaches, against a decision by North Western Traffic Commissioner's to revoke any psv licences held by him should be upheld, the Minister has dismissed the appeal.

The inspector agreed that the Commissioners were correct in ruling that Mr Liversedge was, under section 127(7) of the Road Traffic Act 1960, an unfit person to operate psv, but as he held no licences at the time of the hearing consideration could have been deferred until he applied for some.

The Minister, however, decided that the appeal was wholly academic and in the light of a 1973 decision, Robinson v Secretary of State for the Environment, he dismissed the appeal.
