George A. Brazier was stopped at Tankhill Road, Purfleet on March 3, 1980, in his threeton lorry, loaded with scrap. He failed to produce a goods vehicle ; test certificate, operator's licence, simplified record book and hgv driving licence.

The gross vehicle weight was 7700kg — 200kg over the legal limit. Mr Brazier was unaware that he needed an hgv driving Licence, as he thought he was below the permitted weight of 7500kg.
