Which of the following most accurately describes the problem?

DAMAGES of £172 and costs were awarded at Southport, last week, to William Langstrath, haulier, New Longton, near Preston. He had claimed £215 damages from William Eastwood, Lord Street, Burscough, following an accident involving his lorry last March,

Mr. Langstrath said that in avoiding Mr. Ea'stwood's car his loaded lorry came to rest on the pavement and he estimated £215 as the cost of repairs and loss of the vehicle's use.

Mr. Eastwood replied that he was not wholly to blame for the accident. Mr. Langstrath had panicked, and had gone on to the footpath when there was plenty of room for both vehicles.

Judge Harold Brown decided that, as Mr. Langstrath's speed was "somewhat excessive" at the time, he must bear 20 per cent, of the blame for the accident.
