STATED to have acted as hauliers in the carriage of waste materials, John Perkins and Sons, Ltd., civil engineering contractors, St. Mark's Road, Bristol, were fined £30 and ordered to pay £10 10s. costs at Chester on Monday. They admitted six charges of carrying goods for hire or reward when they held only a C licence.

Mr. G. Ouseley Smith, prosecuting, said that on six days the company not only carried their own goods to -Associated Leadworks, Chester, but also took waste materials from the leadworks to local tips.

"There was no deliberate evasion of the law, but it is difficult to see why a firm of such magnitude should be in doubt as to the law," he remarked. By removing waste for payment they were depriving a licensed operator of part of his livelihood. The company's application for a B licence had recently been refused.

Mr. J. B. Heygarth, defending, said Perkins had been contracting for Associated Leadworks for a number of years. They were paid by the hour for their work and there was no specific payment for removing waste materials.

"They did not intend to operate without a licence and as soon as any doubt was cast on their activities they stopped."
