Which of the following most accurately describes the problem?

• The London Boroughs Transport Committee will make what could be a last-ditch bid to reimpose the controversial condition 11 of the London lorry ban, in the Court of Appeal on 11 June. This follows a Freight Transport Association victory in the High Court last November, when judges threw out the rule forcing operators to fit air brake silencers as a permit condition.

They stated that the authority did not have the power to make such a requirement of hauliers as a condition of getting a permit. If the LBTC loses, its only recourse will be to the House of Lords, but such a path could prove tortuous and expensive. The committee would have to win on three separate legal points to have the decision overturned.

D In the past week the LBTC has prosecuted 15 drivers for breaking the lorry ban.
