IN One of the three operational vehicles of Worcestershire haulier Robert Davies, trading as W E Davies & Sons, has been suspended for three months by West Midlands Licensing Authority Ronald Jackson.
Tenbury Wells-based Davies held a licence specifying three vehicles and five trailers with four vehicles and four trailers to be acquired. He had been called to disciplinary proceedings in the light of an unsatisfactory fleet check.
In addition to suspending an operational vehicle, Jackson deleted the margin from the licence and prematurely terminated it so that it expired at the end of April 1988 instead of in 1991.
A vehicle examiner inspected the three vehicles and five trailers in April and May, finding it necessary to impose three prohibition notices. He reported that inspection records showed irregular inspections; but all defects were being rectified and that there was no driver defect report system. Outlining the steps he had taken to put the situation right, Davies said that regular checks had been carried out but there were no records to show it. In the five years he had been the owner of the business he had never previously had any prohibition on any of his vehicles.
Announcing his decision, Jackson said it was a classic case of "closing the door after the horse had got out." Davies had not complied with the undertaking given when he applied for a licence. The vehicles were obviously not in a fit and serviceable condition and records had not been properly kept.
