ment has dismissed the appeals of Parkers (Suffice° Ltd., Hodgkinsons Transport (Lincoln) Ltd. and 25 other firms against the grant by the East Midland Licensing Authority of licences for 43 vehicles to Larrow Transport (East Midland) Ltd., one of several companies formed to take over the business of Boston Stevedores Ltd.

The Tribunal considered that despite the financial difficulties of Boston Stevedores Ltd. its business was by no means moribund, for the earnings of the Boston-based vehicles rose between 1963 and 1965. Although only some 30 to 40 per cent of the work done was performed by Boston-based vehicles the LA considered that the goodwill of the total business carried out by Boston Stevedores from' Boston was relevant.

The Tribunal held that there was a need for the licensed vehicles in the area and this need was likely to continue. The grant, in their view, would not prejudice the legitimate interests of any other haulier and it was based on a perfectly proper application.
