FFOUR summonses alleging that William Alfred C,astell, 13, The Bungalows, Great Finborough, had infringed the conditions of an A licence by exceeding a radius of 25 miles, were dismissed, last week, by Stowmarket magistrates.

The prosecution said that Castell had three A licences, but a permit to exceed a 25-mile radius was held in respect of only one vehicle. While that vehicle was making journeys under the permit, another went to King's Langley, Burton-on-Trent and Romford.

The defence replied that the permit authorized the carriage of agricultural goods within a radius of 80 miles, but did not specify the vehicle to be used. All the places mentioned were within 80 miles.

A30 Although the prosecution argued that all Castell's vehicles were in use at the time, the bench held that there was no evidence to show the movements of the other lorries, and dismissed the summonses.

Notice of appeal was given when the magistrates dismissed four charges of carrying goods for people other than the firm named in a contract A licence. The defence was that Castell's open A licence and permit to operate within an 80-mile radius covered the journeys in question. The bench accepted this view.

Castell was fined £28 on certain other charges. These referred to the infringement of the terms of a licence, failure to carry a licence disc and the keeping of records.
