• Leigh Magistrates have adjourned hearing a series of charges against the partners in Liverpool-based Carberry Haulage concerning the alleged use of stolen vehicle excise licences.
Hugh Joseph Carberry is accused of one offence of stealing five vehicle excise licences; one offence of dishonestly handling five stolen excise licences; five offences of making a false instrument (an excise licence); five offences of fraudulently using excise licences; five offences of using vehicles without excise licences; and two offences of using vehicles when a higher rate of vEr) was payable.
James Carberry and William Stanton are each accused of five offences of using vehicles without excise licences; and two of using vehicles when a higher rate of VED was payable.
Prosecuting, Mark Smith alleged that Carberry Haulage had been using five vehicle excise licences which were the proceeds of a burglary in Dorset. Hugh Carberry had admitted buying them from a person unknown in a pub, and that he had filled in the details on the licences before they were put on the firm's vehicles. There was a claim for the payment of back duty totalling Z6,328.26.
For Hugh Carberry, Kevin Dooley said that evidence would be produced to show that he was not a partner in Carberry Haulage and had been only a driver.
The magistrates adjourned the hearing until July when they will decide whether the allegations against Hugh Carberry should be dealt with at Bolton Crown Court.
