A DECISION by the Scottish Traffic

Commissioners, refusing him permission to operate a stage carriage service between Airdrie and Kilsyth, was contested last week by Mr. John Carmichael, Glenboig, Lanarkshire. His appeal was heard by Mr. D. M. Campbell, Q.C., acting as Ministry, of Transport inspector.

Mr. Carmichael claimed that sufficient evidence had been put forward for a grant. He asked that if this submission failed, it should be found that a prima facie case had been made out, requiring the objectors to produce rebutting evidence.

The respondents were Scottish Omnibuses, Ltd.. and W. Alexander and Sons, Ltd., who argued that no valid reason had been put forward for the appeal. They pointed out that the granting of a licence was a matter for the discretion of the Traffic Commissioners, and in an appeal it had to be shown that this discretion had been wrongly exercised.
