References were made during the Tribunal hearing to the difficult task that had faced the LA; Judge Inskip, in his summing up, said that the LA had misdirected himself on environmental aspects at the operating centre, and the Tribunal would give details in writing later.

Appearing for a group of local residents, David Mole said that evidence had been given of the access roads being too narrow, authorised

vehicles causing vibration to buildings, and road safety being in danger. The local view was that most of the village is in the vicinity of the operating centre.

The question remained as to how to define "vicinity" and he believed that within reason this is where the effects fall, and that this is different, for instance, in town and country.

"The test of vicinity is that what is in vicinity is area so nearly and closely affected by the use of the operating centre."

Outside the operating centre, it could not be identified where the noise conies from.

But where the noise was caused by authorised vehicles moving in the operating Centre, he said, it was no concern of the LA.
