Which of the following most accurately describes the problem?

• A company which applied for a new excursions and tours licence but did not produce witnesses or evidence in support of the application had not established a prima facie case, and therefore should not be granted the licence.

This was said by Mr Peter Fingret, representing Sheffield United Tours Ltd and Baddeley Bros Ltd, when both companies lodged objections to an application by Shaw's Coaches Ltd, of Barnsley, Yorkshire, for a new excursions and tours licence to cover some 30 destinations. The chairman of the Yorkshire Traffic Commissioners, Maj-Gen Sir John Potter, who heard the case in Leeds last week, decided to uphold the objections by refusing the application.

Sir John said he agreed that a proper case had not been made out by Shaw's Coaches and advised Mr Terry Shaw the director who put forward the application, to seek legal representation before making any future applications.
