sioner Beverley Bell has adjourned her consideration of disciplinary action for maintenance problems against a Derbyshire operator after it was revealed that he had been operating as a limited company for over a year without applying for a new Operator's Licence.

Michael Hobson, trading as Staveley Contractors, of Bolsover, holds a licence for two vehicles. He had been called before Bell after receiving a series of "worryingprohibitions, including some for loose wheelnuts.

Bell pointed out that Hobson had applied for an interim licence in the name of a limited company. Staveley

Contractors. Hobson said he had not realised that he needed a "brand new" licence when the company took on limited status.

Bell said she felt that Hobson had little understanding of what was needed to hold an 0-licence in the 21st century and he needed some education.

She suggested that Hobson contact the Road Haulage Association and he undertook to attend a new operator's seminar on 21 May.

On the issue of maintenance. vehicle examiner David Johnson said that since May 2000 one immediate and Five delayed prohibitions had been issued, as well as a variation notice.

Hobson said that he had been doing all the inspections and repairs himself, as well as driving. The maintenance had now been contracted out and a fitter had been taken on to carry out the repairs because of the number of prohibitions received.

Bell said the maintenance side seemed to have been sorted out. She asked for a copy of the limited company's latest accounts and bank statements, within 28 days. pointing out that Hobson needed to show that there was £6,700 available.

Saying that was 'the easy bit", she added: "The difficult bit is how we are going to get you up into the 21st century by the end of May."

Disciplinary action would be considered at a hearing In late May, said Bell, when she would also deal with the company's licence application.
