Driver: Alistair Adams Matter: Driving standards Hearing: Edinburgh Area: Scotland Presiding TC: Joan Aitken
TRAFFIC COMMISSIONER (TC) for Scotland Joan Aitken has disqualified a truck driver from driving for 18 months after he ignored the instructions of Vosa inspectors.
In a written decision following an April driver conduct hearing in Edinburgh, the TC also revoked the vocational driving licence of Alistair Adams, from Kirkmuirhill, Lanarkshire.
The TC was told officers tried to stop his vehicles on three occasions for safety checks, but encountered difficulties.
Subsequent examinations showed Adams had broken drivers' hours rules and that a vehicle had mechanical defects. Adams admitted that on one occasion he had been concerned about the vehicle and his load, and therefore did not want to exit on the slip road as
directed by the Vosa officers.
On another occasion he had been naive in thinking that they were interested in another vehicle and not his own.
The TC concluded that on the third occasion Adams gave instructions to his son, Andrew, to avoid contact with Vosa officers.
She added: "A motorway is a complex place and when enforcement officers such as Vosa officers give instructions to a driver, those instructions must be complied with."
TC Aitken issued Andrew with a warning after taking into consideration the "overbearing influence of his father". Summing up
The TC also found on the balance of probabilities that Alistair had pushed a Vosa officer during one of the vehicle encounters.
