• Five tanker drivers who lost their jobs when a bulk milk contract changed hands have been awarded more than £27,000 by an industrial tribunal.

They and 14 colleagues formerly employed by Wincanton (Unigate) at the Connahs Quay depot were told there were no jobs for them when they arrived for work at the Gresford premises of the new contractor, family haulage business JH Willis.

At an earlier hearing the Shrewsbury tribunal ruled that the five drivers' contracts were transferred to J11 Willis when it won the Wincanton contract, so the dismissals were automati

cally unfair under the Transfer of Undertakings Regulations.

On Monday (30 September) the remedy hearing ruled that the five were entitled only to the equivalent of a redundancy payment plus 6.5 weeks' notice pay.

They were not entitled to compensation awards, said tribunal chairman David Battisby, because they turned down subsequent job offers by JH Willis.

Transport and General Workers's Union district officer Tommy Kirwan said an appeal would be considered against the tribunal's decision not to award the men compensation.
